When a plaintiff is awarded an eviction, the presiding judge will set a date and time for the defendant to vacate the property.
If the defendant does not vacate by the ordered date and time, the plaintiff must file a CCS form to notify the court of the noncompliance. Be sure to include an email address.
The judge will review the CCS form and can provide an order to the Sheriff’s Department to perform a Sheriff’s eviction at its earliest convenience.
Upon receipt of the judge’s order, the Sheriff’s Department will post a notice on the premises instructing the defendant to vacate by a designated date and time no sooner than 48 hours. A notice will be emailed to the plaintiff indicating the date of the eviction, the time of the eviction, and additional information regarding the eviction.
It is the responsibility of the plaintiff to go to the property the morning of the Sheriff’s eviction and contact the Deputy for Civil Process by 9:00 a.m. if the defendant is still onsite.The plaintiff will need to be prepared to change the locks on the building while the Deputy removes the defendant from the property. If the defendant has vacated the property, the plaintiff may take possession of the property without the Deputy present.
